Terms of Sale

These terms apply to purchases made on bananakit.com. Please read them before placing an order, in particular the section on the right of withdrawal and the exception for sealed hygiene products (section 9.5). Purchases of BananaKit products on other platforms (for example Amazon) are governed by the terms of those platforms.

1. Who we are

The seller is Major Prodotti Dentari S.p.A., the company that owns the BananaKit brand.

2. Who can buy

You must be at least 18 years old to buy on this site. By placing an order you confirm that you are of legal age.
These terms apply mainly to consumers, meaning individuals buying for purposes outside their trade, business or profession. Section 14 contains the additional rules for customers in the United States and section 15 the rules for business customers.

3. Products

Each product page describes the main features of the product, its contents and its materials. Pictures are for illustration: small differences in colour may occur.
BananaKit kits are do-it-yourself casting kits for adults, intended for personal and creative use. They are not intended for medical purposes.
Read the instructions before use. Some components contain natural rubber latex, which can cause allergic reactions. If you have known allergies to any of the materials listed on the product page, do not use the product.
Complete kits include a small battery-powered vibrator. It works with 1 AAA alkaline battery, not included.
Products are sold while stocks last. If a product is no longer available after you have ordered it, we will tell you and refund you in full without delay.

4. Prices

Prices are in euro (EUR) and include VAT. For deliveries in the European Union, VAT is applied at the rate of the country of delivery, as required by EU VAT rules.
Delivery costs are shown separately in the cart and at checkout, before you place the order.
When we announce a price reduction, we also show the lowest price applied in the 30 days before the reduction.
We do not personalise prices on the basis of automated decision-making.
If a price on the site is clearly wrong because of an obvious technical error, we will tell you before accepting your order and you can choose whether to continue at the correct price or cancel.

5. Delivery areas and costs

We deliver to the countries that can be selected at checkout, including the United States. At the date of this version, standard delivery costs are:

The amount that applies to your order is always the one shown at checkout before you confirm. Orders are shipped with selected express couriers, in plain packaging with no brand name on the outside.

6. How the contract is concluded

Choose your products and add them to the cart.
At checkout, enter your billing and delivery details and choose a payment method.
Before you confirm, you can check the order summary and correct any error by going back to the cart or editing the fields.
Tick the box to confirm that you are at least 18, that you accept these terms and that you have read the information on withdrawal, including the exception for sealed hygiene products.
Click the button “Place order and pay”. This is an order with an obligation to pay.

After you submit the order you will receive an email acknowledging it. The contract is concluded when we send you the order confirmation email, which we send once payment has been authorised. The confirmation includes the order summary and these terms, so that you can keep them. We also keep a copy of your order, which you can request at any time.

The contract is concluded in the language you are using on the site.

7. Payment

You can pay with the methods shown at checkout: cards and digital wallets through Stripe, or PayPal.
Payment is charged when you place the order.
We never see or store your full card number. Payments are processed securely by Stripe or PayPal.
An invoice is issued if you request it at checkout or if the law requires it.

8. Delivery

We ship your order within 2 working days of the order confirmation. After shipment, delivery usually takes:

These times are indicative. In any case, unless agreed otherwise, we deliver within 30 days of the contract.

If we cannot deliver within the agreed time, you can set an additional reasonable period. If we still fail to deliver, you can terminate the contract and we will refund you without delay. Where the delivery date was essential, you can terminate immediately.
The risk of loss or damage passes to you when you, or a person you have chosen other than the carrier, take physical possession of the goods.
Please check the parcel on delivery. If it is visibly damaged, you can accept it with reservation or refuse it. If you find damage after delivery, please tell us within 48 hours with photos of the packaging and the product, so that we can claim from the carrier faster. This request does not limit your rights under the legal guarantee (section 10).

9. Right of withdrawal

9.1 Your right

If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason, subject to the exception for sealed hygiene products in section 9.5.

The withdrawal period expires 14 days after the day on which you, or a third party you have chosen other than the carrier, take physical possession of the goods. If you ordered several products delivered separately, the period starts from delivery of the last one.

9.2 How to withdraw

To withdraw, you must inform us of your decision before the period expires. You can do so in any of these ways:

with the “Withdraw from contract here” function on our site, available at bananakit.com/withdraw-from-contract/ and in your account. Enter your name, your order number and the email address where you want to receive confirmation, then click “Confirm withdrawal”;
by sending the model withdrawal form below, or any other clear statement, to sales@bananakit.com or to majordental@pec.it;
by post to Major Prodotti Dentari S.p.A., Via Luigi Einaudi 23, 10024 Moncalieri (TO), Italy.

Using the model form is not mandatory. We will send you an acknowledgement of receipt by email without delay.

9.3 Returning the products

You must send back the products without undue delay and in any case within 14 days of the day you told us that you are withdrawing. We will give you the return address in the acknowledgement email. Please pack the products so that they are protected during transport.

Unless the product is faulty, damaged or not what you ordered, you pay the direct cost of returning the products.

You are only liable for any loss in value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

9.4 Refund

We will refund all payments received from you, including the standard delivery costs, without undue delay and in any case within 14 days of the day we are informed of your decision to withdraw. If you chose a delivery method more expensive than the standard one we offer, we do not refund the extra cost.

We refund using the same payment method you used for the order, unless you expressly agree otherwise. You will not pay any fees for the refund. We may withhold the refund until we have received the products back or you have supplied proof of having sent them, whichever is earlier.

9.5 Exception for sealed hygiene products

Under Article 59(1)(e) of the Italian Consumer Code (Article 16(e) of Directive 2011/83/EU), the right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons, if they have been unsealed after delivery.

The BananaKit tube is our hygiene seal. It is closed by a clear plastic band that wraps the whole tube; to open the tube you have to remove the band. Everything inside the tube, including the casting materials and the vibrator, is intended for intimate contact with the body and, once the tube has been opened, cannot be cleaned and sold again safely.

This means that:

as long as the band is intact, you have the full right of withdrawal: you can withdraw and return the product within 14 days. Opening the shipping box does not affect your right;
if you remove or break the band, you lose the right of withdrawal for the whole content of the tube, vibrator included.

Refills sold separately are sealed as follows:

Alginate refill. The bag is sealed closed and can only be opened by cutting it. As long as the bag is intact, you have the full right of withdrawal. Once you cut it, you lose the right of withdrawal for that bag.
Silicone refill. The refill is a single set of two jars, base and catalyst: they are mixed together, neither can be used without the other and they are not sold separately. Each jar has an aluminium foil glued under the cap, which protects the content and prevents leaks; to open a jar you have to peel off its foil. As long as both foils are intact, you have the full right of withdrawal. Once you peel off the foil of even one jar, you lose the right of withdrawal for the whole set.

Opening the shipping box or any outer packaging does not affect your right: only removing the seals described above does.

We tell you about this exception on each product page and at checkout, before you buy. If you change your mind, please do so before removing any seal.

The exception does not affect your rights if the product is faulty, damaged or not what you ordered: in those cases the legal guarantee applies (section 10), whether or not the seal has been removed.

10. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity under Articles 128 and following of the Italian Consumer Code.

We are responsible for any lack of conformity that becomes apparent within 2 years of delivery.
A lack of conformity that becomes apparent within 1 year of delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the product or of the defect.
Please tell us about the defect within 2 months of discovering it. You can claim your rights in court within 26 months of delivery.
You are entitled to have the product brought into conformity by repair or replacement, free of charge. Where this is impossible, disproportionate or not done within a reasonable time, or in the other cases provided by law, you are entitled to a price reduction or to terminate the contract and be refunded.
For consumables such as alginate and silicone, conformity also means that the product works as described when used before its expiry date and according to the instructions.
If the law of the EU country where you live gives you a longer or more favourable guarantee, that law applies.

To use the guarantee, write to sales@bananakit.com with your order number, a description of the problem and, where possible, photos. For faulty, damaged or incorrect products we pay the cost of the return.

We do not offer an additional commercial guarantee.

11. Customer service and complaints

12. Out-of-court dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body (alternative dispute resolution, ADR). If a complaint cannot be resolved directly with us, you can still turn to the ADR bodies of your country, and for cross-border disputes in the EU you can ask the European Consumer Centre of your country for free help (www.eccnet.eu). The EU online dispute resolution (ODR) platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228, so we no longer link to it.

13. Liability

We are liable under the law for the products we sell. Nothing in these terms excludes or limits your rights as a consumer, or our liability for death or personal injury, fraud, gross negligence or any liability that cannot be limited by law.

We are not liable for damage caused by use of the products contrary to the instructions and warnings provided.

14. Customers in the United States

This section applies when we deliver your order to an address in the United States. In case of conflict, it prevails over the rest of these terms.

Seller and currency. You buy from Major Prodotti Dentari S.p.A., an Italian company. Prices are in euro. Your card issuer or PayPal converts the amount into U.S. dollars and may charge a conversion fee.
Duties, taxes and customs fees are paid by you. We ship to the United States on a DAP (Delivered at Place) basis. The prices and delivery costs shown at checkout do not include U.S. import duties, taxes (including any sales tax) or customs clearance fees. These charges are requested by the courier or by customs before or at delivery and must be paid by you to receive the parcel. The amount depends on U.S. rules and is not set by us.
Delivery time. Indicatively 7 to 14 working days after shipment, plus any time needed for customs clearance.
Returns. We offer you the same 14-day return policy described in section 9, including the exception for sealed hygiene products. If a product arrives faulty, damaged or incorrect, contact us at sales@bananakit.com and we will replace or refund it. Duties and customs fees paid on import are not refunded by us.
Warranties. Nothing in these terms limits any implied warranty that applies under the law of your state.
Limitation of liability. To the extent permitted by the law of your state, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential damages. Some states do not allow these limitations, so they may not apply to you. This limitation does not apply to liability for death or personal injury caused by our negligence, or to fraud.
Governing law and disputes. These terms are governed by Italian law, without prejudice to any consumer protection rights you have under the law of your state that cannot be waived by agreement. You may bring a claim in the courts of Turin, Italy, or in the small claims court where you live, if it has jurisdiction.
Privacy. See Part B of our Privacy Policy and the Do Not Sell or Share My Personal Information page.

15. Business customers

If you buy for purposes related to your trade, business or profession (for example by entering a VAT number at checkout):

the rules for consumers in these terms (in particular the right of withdrawal and the consumer legal guarantee) do not apply, unless the law provides otherwise;
for intra-EU deliveries to a VAT-registered business whose VAT number is validated through the EU VIES system, the invoice is issued without Italian VAT under the reverse-charge rules;
the contract is governed by Italian law, excluding the UN Convention on Contracts for the International Sale of Goods, and the Court of Turin, Italy, has exclusive jurisdiction.

16. Applicable law and jurisdiction for consumers

These terms are governed by Italian law. If you are a consumer habitually resident in another country, you keep the protection given by the mandatory provisions of the law of that country.

For consumers, the competent court is the court of the place where you live or are domiciled. You can also bring a claim in the court of the place where we are established.

17. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it, which we send you with the order confirmation.

18. Disposal of old electrical devices (WEEE)

The vibrator included in complete BananaKit kits is an electrical device. At the end of its life it must not be thrown away with household waste.

Crossed-out wheeled bin. This symbol on the device or its packaging means that the device must be collected separately from unsorted household waste. Separate collection allows materials to be recovered and keeps harmful substances out of the environment.
Battery. The device works with 1 AAA alkaline battery, not included. Remove the battery before disposing of the device and take it to a battery collection point. Batteries must not go in household waste either.
Personal data. The device does not store personal data.
Where to return it, free of charge. You can return old devices free of charge to the separate collection points of your municipality (for example the recycling centre). In some countries, retailers also take back old devices free of charge: ask at the point of sale or check your local rules.
Italy. When you buy a new device from us, you can ask us to take back free of charge a used device of an equivalent type (“one-for-one” take-back). Contact sales@bananakit.com before delivery to arrange it. Shops with an electronics sales area of at least 400 square metres must also take back very small devices (up to 25 cm) without any purchase (“one-for-zero”). Improper disposal of electrical waste is punishable under the law.
Germany. Our WEEE registration number is DE 63916986 (stiftung ear, authorised representative mplan eG, Munich). You can return old devices free of charge to municipal collection points (Wertstoffhöfe) and to retailers obliged to take them back.
Other countries. Follow the separate collection rules of the country where you live.

Our packaging can be recycled: please dispose of it according to the separate waste collection rules in your area.
